{"id":1459,"date":"2020-02-05T14:41:34","date_gmt":"2020-02-05T19:41:34","guid":{"rendered":"http:\/\/cop-legal.com\/?p=1459"},"modified":"2020-02-05T15:37:22","modified_gmt":"2020-02-05T20:37:22","slug":"mypymes-convierten-ordenes-de-compra-y-de-servicio-en-titulos-valores-negociables","status":"publish","type":"post","link":"https:\/\/cop-legal.com\/en\/mypymes-convierten-ordenes-de-compra-y-de-servicio-en-titulos-valores-negociables\/","title":{"rendered":"MIPYMES: CONVIERTEN \u00d3RDENES DE COMPRA Y DE SERVICIO EN T\u00cdTULOS VALORES NEGOCIABLES."},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Mediante Decreto de Urgencia N\u00b0 013-2020 publicado en el diario oficial El Peruano el 23 de enero, se han dictado normas que promueven el financiamiento de las Mipyme, emprendimientos y start-ups. Entre otros beneficios se ha dispuesto otorgar la condici\u00f3n de t\u00edtulo valor a las \u00f3rdenes de compra y \u00f3rdenes de servicio entregadas por las entidades del Estado a las micro, peque\u00f1as y medianas empresas (mipymes) proveedoras del Estado. Esta norma permitir\u00e1 el uso de los citados t\u00edtulos valores como medio de liquidez para la obtenci\u00f3n de capital de trabajo necesario para financiar el cumplimiento de sus obligaciones contractuales con las entidades estatales.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La norma no limita las fuentes de financiamiento a las MIPYME a las \u00f3rdenes de compra o de servicios emitidas por las entidades del Estado a favor de las primeras, sino que tambi\u00e9n tiene por finalidad promover el acceso a financiamiento mediante el uso de la factura negociable, el arrendamiento financiero y el impulso a la actividad de financiamiento participativo.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">En el caso de la emisi\u00f3n de facturas y recibos por honorarios por operaciones a cr\u00e9dito la norma establece que ser\u00e1 obligatorio que se debe indicar en ellos el plazo de pago acordado y el monto pendiente de pago. Los mencionados comprobantes de pago ser\u00e1n puestos en conocimiento de SUNAT y el adquirente dentro de los 2 d\u00edas siguientes a su emisi\u00f3n y \u00e9ste \u00faltimo tendr\u00e1 un plazo de 8 d\u00edas para manifestar su disconformidad, sea con el plazo para el pago, con el monto pendiente de pago o como ambos o para manifestar su reclamo por los bienes adquiridos o los servicios recibidos.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Si dentro del plazo de 8 d\u00edas indicado en el p\u00e1rrafo precedente el adquirente o usuario no manifiesta su disconformidad, se presume la conformidad sin admitirse prueba en contrario. No obstante, en caso de existir conformidad respecto al plazo para el pago y el monto pendiente de pago, existiese disconformidad con el bien o servicio, el usuario o adquirente podr\u00e1 oponer las excepciones personales que le correspondan, pero no podr\u00e1 cuestionar o retener el monto pendiente de pago ni demorarlo.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">En caso de no pago oportuno del saldo pendiente, este generar\u00e1 intereses a las tasas m\u00e1s altas permitidas por el Banco Central de Reserva del Per\u00fa.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">La norma establece que el Ministerio de la Producci\u00f3n publicar\u00e1 la relaci\u00f3n de adquirentes de bienes o usuarios de servicios que incumplan con los plazos de pago acordados.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mediante Decreto de Urgencia N\u00b0 013-2020 publicado en el diario oficial El Peruano el 23 de enero, se han dictado normas que promueven el financiamiento de las Mipyme, emprendimientos y start-ups.
