{"id":1478,"date":"2020-02-11T14:40:58","date_gmt":"2020-02-11T19:40:58","guid":{"rendered":"http:\/\/cop-legal.com\/?p=1478"},"modified":"2020-02-11T14:42:21","modified_gmt":"2020-02-11T19:42:21","slug":"1478-2","status":"publish","type":"post","link":"https:\/\/cop-legal.com\/en\/1478-2\/","title":{"rendered":"DECRETO SUPREMO QUE DECLARA EN REORGANIZACI\u00d3N AL ORGANISMO SUPERVISOR DE LA INVERSI\u00d3N EN ENERG\u00cdA Y MINER\u00cdA &#8211; OSINERGMIN"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Mediante Decreto Supremo 023-2020-PCM publicado con fecha 10 de febrero de 2020 en el diario oficial El Peruano, se declara en reorganizaci\u00f3n al Organismo Supervisor de la Inversi\u00f3n en Energ\u00eda y Miner\u00eda &#8211; OSINERGMIN para as\u00ed poder evaluar la actual situaci\u00f3n administrativa, organizativa y de gesti\u00f3n, para proponer y ejecutar medidas de reforma administrativa.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El Decreto Supremo, entre otros dispone lo siguiente:&nbsp;<\/span><\/p>\n<ol start=\"1\">\n<li style=\"list-style-type: none;\">\n<ol start=\"1\">\n<li>La constituci\u00f3n del Comit\u00e9 de Reorganizaci\u00f3n del Osinergmin<span style=\"font-weight: 400;\">, el cual se encargar\u00e1 de proponer las acciones y medidas de reforma administrativa y de gesti\u00f3n que correspondan y estar\u00e1 conformado por dos (2) representantes del Despacho Ministerial de la Presidencia del Consejo de Ministros (uno de los cuales preside el Comit\u00e9), dos (2) representantes del Ministerio de Energ\u00eda y Minas y un (1) representante del Osinergmin.<\/span><\/li>\n<p><span style=\"font-weight: 400;\">El Comit\u00e9 de Reorganizaci\u00f3n tendr\u00e1, entre otras, las siguientes funciones:&nbsp;<\/span><\/p>\n<ol style=\"list-style-type: lower-alpha;\">\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">evaluar la normativa vigente vinculada a los criterios operativos, administrativos y t\u00e9cnicos que utiliza el Osinergmin para la determinaci\u00f3n de sus procesos y procedimientos; y,&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Proponer cambios a la normativa vigente que permitan el fortalecimiento de los procesos evaluados en el marco del literal precedente, de modo tal que se cumplan y mantengan los est\u00e1ndares de calidad y se garantice la seguridad de la ciudadan\u00eda.<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">El plazo de vigencia del Comit\u00e9 de Reorganizaci\u00f3n es de noventa (90) d\u00edas calendario, plazo dentro del cual debe presentar al Despacho Ministerial de la Presidencia del Consejo de Ministros el respectivo Informe Final con las conclusiones de la evaluaci\u00f3n realizada, recomendando las acciones a adoptar en el corto y mediano plazo.<\/span><\/p>\n<li><span style=\"font-weight: 400;\">El Decreto Supremo Como disposici\u00f3n complementaria final, ha <\/span>suspendido por el plazo de noventa (90) d\u00edas calendario el otorgamiento de autorizaciones de transporte terrestre, almacenamiento, distribuci\u00f3n y comercializaci\u00f3n de gas licuado de petr\u00f3leo (GLP).&nbsp;<\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Adicionalmente, para las empresas que a la fecha cuenten con autorizaciones vigentes, el OSINERGMIN iniciar\u00e1 un proceso de revalidaci\u00f3n para lo cual emitir\u00e1 las disposiciones normativas correspondientes en un plazo no mayor de treinta (30) d\u00edas calendario.
